Insurance Defense

Unice Salzman Jensen, P.A. represents local, national and international insurance companies in a wide variety of insurance defense matters in both state and federal courts. Our firm is experienced in all aspects of insurance defense including insurance defense litigation, mediation, arbitration and negotiation.

Litigation

Unice Salzman Jensen, P.A. is a firm dedicated to litigation. We have the experience necessary to take cases through the litigation process from beginning to end. T.R. Unice Jr. is board certified by the Florida Bar in civil trial. Every board certified civil trial lawyer has practiced law for at least five years and been substantially involved -- 30 percent or more -- in the area of civil trial law during the three years preceding application. To be certified, the lawyer is required to have conducted at least 15 contested civil cases in courts of general jurisdiction during the lawyer's practice, including cases before a jury and as lead counsel. Credit is given to the lawyer if he or she has served as a judge. Each certified lawyer must also have passed peer review, completed 50 hours of continuing legal education within the three years preceding application and passed a written examination demonstrating knowledge, skills and proficiency in the field of civil trial law to justify the representation of special competence.

Workers' Compensation

Unice Salzman Jensen, P.A. represents employers and insurance companies in all types of workers' compensation cases, including catastrophic injuries, credibility cases, complex medical causation cases, medical benefits, and permanent total disability. We also represent employers in obtaining reimbursement from second injury trust funds and collateral sources. We are able to draft and establish drug-free workplace policies, provide updated changes in the law and counsel employers on best practices to minimize exposure.

Insurance Bad Faith Litigation

Unice Salzman Jensen, P.A. defends local and national insurance companies in bad faith litigation. Bad faith is the opposite of “good faith.” Bad faith litigation can be defined as actual or constructive fraud, or a design to mislead or deceive another, or a neglect or refusal to fulfill some duty or some contractual obligation, not prompted by an honest mistake as to one’s rights or duties, but by some interested or sinister motive. Insurance companies generally have a duty to act in good faith with fair dealing. Bad faith can allow a plaintiff to recover an amount in excess of the original face value of the insurance policy if the insurance company’s conduct is found to be in bad faith. Unice Salzman Jensen, P.A. defends bad faith litigation claims throughout the state of Florida.

Governmental Defense

Unice Salzman Jensen, P.A. represents local governmental agencies. Shareholder and partner Andrew Salzman is actively involved in governmental representation including serving as Town Attorney for the Town of Redington Beach, along with representing the City of Clearwater; labor/employment law, handling all matters for Lealman Special Fire Control District, Spring Hill Fire Rescue and Emergency Medical Services District, Palm Harbor Fire District, Palm Harbor Community Services Agency, East Lake Tarpon Special Fire Control District along with other private enterprises.

Civil Rights Litigation

Unice Salzman Jensen, P.A. has the pleasure of defending numerous municipalities and other Governmental entities from claims of civil rights violations and police misconduct in state and federal court. State claims of police misconduct are governed by Florida's waiver of sovereign immunity, and an understanding of the many preconditions, exclusions, and exceptions found in § 768.28 is vital to successfully defending such claims. Civil rights claims brought pursuant to 42 U.S.C. § 1983 are very fact intensive, and an understanding of law enforcement policies and practices is key to successfully litigating these claims. Our civil rights defense team includes an attorney with over twenty years of state and federal law enforcement experience. We have successfully defended law enforcement officers in excessive force cases. Our firm also handles appeals in state and federal courts.

Employment/Labor Representation

Unice Salzman Jensen, P.A. provides support to employers throughout all aspects of the employment relationship and assists in navigating the constantly shifting currents of employment issues which employers face on a day-to-day basis from screening, selection and hiring of personnel, through discharge planning and post discharge litigation proceedings. We can assist with any human resource, payroll, benefits, workers' compensation or other employee related or union issues your business may face. We are also prepared to assist in the defense of any Title VII discrimination claim (Title VII of the Civil Rights Act of 1964 prohibits covered employers from discriminating in employment on the basis of race, color, religion, sex, or national origin), claims for age discrimination, wage and hour claims, or "employment torts." Unice Salzman Jensen, P.A. is able to train and educate employers to be proactive and assist in the creation of best practices and policies.

Unice Salzman Jensen, P.A. represents companies and individuals where insurance is unavailable with respect to a threatened or pending lawsuit. Premises Liability

Unice Salzman Jensen, P.A. defends premises liability claims throughout the state of Florida. Property owners are generally responsible to provide a reasonably safe environment for those who come onto their premises. Premise liability law has evolved in Florida and there are many new requirements a plaintiff must prove in order to show negligence on the behalf of the defendant. Our team of attorneys have successfully defended premises liability claims throughout the state of Florida.
